1. Acceptance of Terms

By creating an account, submitting cleanup data, or browsing the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy & PDPA Notice.

2. Description of Service

Blue Santa Malaysia is a community-driven platform designed to track, verify, and showcase the environmental impact of ocean and beach cleanup activities. Our services include user registration, cleanup data submission, evidence verification, a public scoreboard, and community event management.

3. User Accounts & Registration

• Eligibility: You must provide accurate, current, and complete information during the registration process.
• Account Approval: Accounts require email verification and administrative approval before data submission features are unlocked. We reserve the right to reject or disable accounts that violate these Terms or submit suspicious data.
• Account Security: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
• Membership ID: Upon registration, you will be assigned a unique Membership ID. This ID is non-transferable.

4. User Conduct & Data Integrity

As a platform built on trust and environmental impact, the accuracy of data is paramount. You agree NOT to:

• Submit falsified, exaggerated, or fabricated cleanup logs or waste weights.
• Upload photos that are not your own, are AI-generated, or do not represent the actual cleanup location or activity.
• Use the platform for any unlawful purpose or to promote harmful behavior.
• Attempt to bypass administrative reviews or manipulate the scoreboard.
• Impersonate another person or use another person's IC/Passport number without authorization.

Any violation of data integrity may result in immediate account suspension and removal of your data from the scoreboard.

5. Content Ownership & License

• Your Content: You retain ownership of the content you submit (e.g., cleanup photos, location data). By submitting content, you grant Blue Santa Malaysia a worldwide, non-exclusive, royalty-free license to use, reproduce, and display this content for the purpose of operating the platform (e.g., displaying evidence to admins, mapping hotspots, and generating impact reports).
• Platform Content: The design, logo, code, and editorial content created by the platform administrators are the property of Blue Santa Malaysia and Engineered by Brewspark.co.

6. Public Scoreboard & Display

You acknowledge that by submitting approved cleanup data, certain information—specifically your Display Name (Nickname or First Name), State/Country, and Total Waste Collected—will be publicly displayed on the Live Scoreboard to encourage community engagement.

7. Administrative Review

All cleanup submissions are subject to administrative review. We reserve the right to approve, reject, or request modifications to any submission to ensure data quality and platform integrity.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.

9. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. Blue Santa Malaysia makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service. We do not guarantee that the platform will be uninterrupted, secure, or error-free.

10. Limitation of Liability

In no event shall Blue Santa Malaysia, its administrators, or its developers (including Brewspark.co) be liable for any indirect, incident, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your access to or use of (or inability to access or use) the service.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
